1. Introduction

This document details the Terms and Conditions (the “Terms”) under which you may use the services, facilities, and products of the Hawaiian Volcanic Organic Farm Institute (referred to as “HVOFI” or “we” or “our”). By accessing or using our services or facilities, you agree to be bound by these Terms.

2. Registration and Membership

Membership with HVOFI may require registration. During registration, users must provide accurate and complete information. It is the responsibility of the user to keep this information updated.
Misrepresentation or false information can result in suspension or termination of membership.

3. Products and Services

HVOFI offers various products and services related to organic farming. We strive to ensure the quality of all our products, but we cannot guarantee the same due to the natural and organic nature of farming practices.
Our services and products are subject to availability and may be changed, withdrawn, or amended without prior notice.

4. Payment Terms

Payments for products or services should be made within the timelines set by HVOFI. All transactions are to be done in the currency specified by HVOFI.

5. Refund and Cancellation

Any cancellations or changes to orders should be communicated within 24 hours of placing the order. Refunds for cancellations are at the sole discretion of HVOFI. In case of damaged or unsatisfactory products, please contact our customer service within 48 hours of receipt. Refunds or replacements will be processed based on the individual case.

6. Intellectual Property

All content, designs, logos, and other intellectual property related to HVOFI are our exclusive property and are protected under applicable copyright, trademark, and other intellectual property laws. Unauthorized use or reproduction is strictly prohibited.

7. Liability

HVOFI shall not be liable for any direct, indirect, special, or consequential damages resulting from the use or inability to use our products or services.
We are not responsible for any damages or injuries that may arise due to natural events, including but not limited to volcanic activity.

8. Conduct

All members and visitors to HVOFI are expected to conduct themselves respectfully and safely. Any behavior deemed disruptive or unsafe may result in expulsion from the institute or termination of membership.

9. Privacy

Any personal data collected by HVOFI is subject to our Privacy Policy, which is incorporated herein by reference.

10. Termination

HVOFI reserves the right to terminate membership or access to our services for any breach of these Terms.

11. Changes to Terms

We reserve the right to modify, amend, or change these Terms at any time without prior notice. It is your responsibility to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed by the laws of the state of Hawaii, without regard to its conflict of laws rules.

13. Disputes

Any disputes arising out of these Terms shall be resolved through amicable negotiation, failing which, shall be subjected to the jurisdiction of the courts of the state of Hawaii. By using our services or accessing our facilities, you acknowledge and agree to abide by the aforementioned Terms and Conditions. If you do not agree to these Terms, please refrain from using our services or facilities.
